These agents always require you to sign a non-disclosure agreement. We did with an agent re a business in NSW. Later we did the same with another agent for what turned out to be the same business. We bought the business through the second agent who was really good and professional and convinced us to buy the business. We never dealt with the first agent other than receive some info on the business via email- an Information Memorandum. This first agent is now claiming his commission from us because the non-disclosure agreemnt contained a clause saying that we agreed that he was responsible for introducing the business to us and would be entitled to his commission from us if we bought the business through another agent. This is ridiculous as the business was sold on an open agency agreement through a number of agents - all of whom had the same info to disclose! Is this a legal claim?
