    Real estate agency policy limiting iterstate buyers

    Hello

    I am interested to know if anybody interstate buyer come across a policy in real estate agency that buyer have to see personally property before you put the offer down.

    I never came across this before.  Has anybody did? Does anybody knows where I can stand as a consumer in this situation?

    I  indicated that I want to make an offer on the property but was denied the right to do so due to that policy. I am interstate buyer and usually if offer is accepted you spend money to fly there and inspect, but not in this case.   There is a story to it, with the same agency I had offer accepted on another property.  Based on pest inspection I canceled the contract.

    I spoke with new property agent and emailed twice with request of Section 32 to start the process of making the offer and only after emailing the director of the agency then agent email me about this "policy"

     As a consumer were do I stand here?

    You should make direct contact with the owner of the property, let them know that you have no confidence in the real estate agent, and ask them to assist you by putting you or your lawyer in touch with the vendor's lawyer.

    Thank you, Peter for your reply.

    I complaint to them(that any offer in writing should be presented to vendor), they took silent couple of days and I was advised it was sold.  All together going backward and forwards, two weeks were lost and property is sold now. 

     Without Section 32(I am buying in VIC) how would you able to find out vendor's name? They refused to provide it to me till I fly there to inspect the property.

     I am moving on, I just hope that when good property will come along it will not be with Andrew Milne real estate. We have been buying for years and never seen such cowboys.

    Agency is Andrew Milne Real estate in Frankston VIC. http://www.milnere.com.au/

    I was in communication with Lynn(sales rep) asking her 3 times to send me S32 and never got a reply from her via email. I spoke with her origianly over the phone asking for S32 and she said she will send it.

    Then I CC Andrew(Director) who never come back to me directly.  Then from other REP(Mark) I received this: "andrew  milne   who  owns the company  has   said  it is   now  company  policy  to see  properties  before  you offer   , happy send  sec    32   must   jump on plane  and  see    the  home"

     I replied(CC director) saying I would like to make an offer and "If I am not mistaken, any written offer must be presented to the vendor".

    Then I've got email from Mark saying property is sold. 

    Twice I prompted Mark asking to clarify if new policy still stands and never got a direct answer.  I really doubt that policy is even written, but was used a just and excuse. Of course I can avoid this agency and spread the word of concern, but I have not idea where I stend with them if good propererty comes on the market which I will want to buy and if it will be with this agency. :-(
