    Contract Exchange

    Should I ever exchange contracts ...

    1. if the cooling off period is taken out because its "local practice" (Section 66W of the Coneyancing Act NSW)?

    2. if it is suggested (by the conveyancer) to not do the Identification Survey Report with the conveyancer as there is no time?

    3. relying on a title search from 2007 and not an up to date one?

    4. the sewage plan shows the building incorrect, even though the pipes seem to be correct?

    5. the pest & building must be obtained with in 7 days of the exchange date and I have 3 days to give notice to the vendor?

    I must add I really want to buy the house but I want to ensure I buy something which is worth the price - not only emotionally.

    Your question indicates a misunderstanding of the role of the lawyer.  The lawyer advises on legal rights and obligations, but cannot give advice on matters which involve personal decisions.

    You know that there are risks associated with signing a contract in the circumstances you have outlined, so why ask someone else what you should do?

    If you take risks you can get hurt, and you know that.  But if you don't take risks you may end up being disappointed, and you know that too.

    What should you do?  Only you can answer that.

    Thank you Peter, that is only to some degree helpful, as all those things have a legal rationale or impact and this is what I am after...to understand, maybe my question is misleading, if so I am sorry, but still hope to get advice.

    sorry me again..I do not know the answers to these questions - i.e. must the title search be as per month of exchange?
